Board Meeting Minutes of July 11, 2006

Convening: Meeting was called to order at 7:32 pm. Meeting was held in the Phillips School Library.

Minutes: A motion was made to approve the minutes of the June 13, 2006 minutes. Motion was carried and the June 13, 2006 minutes were approved as written, signed and accepted for the record.

Open Forum:
Bob Nelson, 7077 Leestone Street, was present to discuss parking & towing issues. In summary, Mr. Nelson related an event where illegal parking by another placed him at medical risk because his vehicle was blocked. Mr. Nelson demanded that the Board take action immediately with regard to parking. The negligent enforcement of parking restrictions was discussed as was the need for towing. Mr. Nelson offered to be a ticketing agent for the Board in his area of Leewood. Reasonable levels of enforcement were discussed as was the need to advertise that parking/towing would be enforced more vigorously than it has been in the recent past. A newsletter/website article on this topic was also considered and determined to be a good idea. Mr. Nelson was informed that a new towing contract had been negotiated. The Board agreed that this information should be posted on the website/published in the next newsletter, and will see that it is done.

Bob Flynn, 7072 Leestone Court, was present to discuss storm damage with regard to trees. Mr. Flynn expressed his belief that the downed trees and vegetation left by the July storms had not been cleaned up completely, and that the contracted lawn company needs to clean up the common areas as soon as possible. Concern was also expressed regarding the stability of certain trees on Leewood property and the possible need for their removal before more damage was caused. Storm damage to the perimeter fence was also discussed. It was determined that Al Sanford, Grounds & Maintenance, would be notified so that he could initiate the repair of the fence and schedule a day for the lawn company to clean storm debris in the common areas. Mr. Flynn was informed that routine cleaning/clearing of the common area had been discussed at the 13 June 2006 meeting and in the future would occur once in the spring and once again in the fall. It was also decided that the Fairfax County Arborist would be contacted regarding large tree removal so that Leewood would not inadvertently violate any county/state conservation restrictions. 

Architectural Review Hearings:

At 8:15 pm it was moved that the Board adjourn to executive session in order to conduct eight (8) scheduled ARC violations hearings. The motion was approved and the hearings were conducted. The Board reconvened in open session at 8:57 pm. Once in open session, the following motions were approved/announced with regard to the ARC hearings:

A 90 day extension was granted for the following violation at 5263 Bradgen Court: “gate should be double fenced or good (finished side) of fence should be facing out.” Homeowner was present for hearing and left immediately after.

Penalties were assessed, effective 1 Aug 06, for the following violation at 7026 Bradwood Court: “rake board in rear (next to 7028) is missing; needs replaced & painted.” Homeowner was present for hearing.

Hearings “in absentia” were held, and penalties assessed, effective 1 Aug 06, for violations at the following property’s: 5259 Leestone Court; 7075 Leestone Street; 7078 Leestone Street; 7082 Leestone Street; 7001 Leebrad Street and 7028 Bradwood Court.

Architectural Review Committee (ARC)

The following motions were made and approved regarding active, alleged ARC violations:

Hearings will be scheduled and notification letters sent for alleged violations at the following property’s: 7035 Bradwood Court; 7014 Leebrad Street; 7043 Leebrad Street; 7062 Leebrad Street; 5267 Leestone Court; 7031 Leestone Street; 7056 Leestone Street; 7071 Leestone Street; 7074 Leestone Street; 7075 Leestone Street; 7082 Leestone Street and 7088 Leestone Street.

Extensions will be granted and notification letters sent for alleged violations at: 7056 Leestone Street.

Hearings will be re-scheduled and notification letters sent for alleged violations at: 7037 Leebrad St.

Second notices were approved for alleged violations at: 7020 Bradwood Court; 7032 Bradwood Court; 5255 Leestone Court; 5259 Leestone Court; 5265 Leestone Court; 5266 Leestone Court; 5267 Leestone Court; 7001 Leestone Street; 7007 Leestone Street; 7015 Leestone Street; 7019 Leestone Street; 7027 Leestone Street; 7039 Leestone Street; and 7082 Leestone Street.

President’s Report: The President continues to work parking issues, and to that end presented a proposed towing contract for the Board’s review. A motion was made and passed that the contract be approved as acceptable and that it be negotiated with the towing company and activated. It was also motioned and approved that the contract be posted on the Website and included in the next newsletter.

Financial Report: Leona Taylor gave the financial report. Of note was the fact the our Deferred Assets Payable are close to reaching the cap, and that to avoid penalties/additional taxes on that money, we need to spend some of this money on a qualifying project such as capitol improvements to the community. Grading and drainage were discussed as necessary projects that would qualify for this account. Financial statement attached.

Activity Report – Homeowner Accounts / Website: Judy currier provided a written activity report, which provided the following:

Homeowner Accounts: Only one special assessment letter was mailed. This is a first! Assessments were collected for the property at 7037 Leebrad Street. Further back assessments for this property have been paid to our attorney, who will forward those funds to us once they clear the bank.

Penalty Accounts: No penalty accounts have been started. Penalties were collected as the result of a court hearing for the property at 5253 Bradgen Court.

Website: Fresh financials have been posted.

There was another episode of inappropriate postings; in an effort to get this under control, a motion was made and passed that a draft policy be formulated with regard to steps to be taken when messages are posted that appear to be in violation of our posting guidelines. Judy has volunteered to draft this policy for the Board’s review.

Judy also provided information on a new law regarding solar panels.

Grounds and Maintenance: Al Sanford was not present; subsequently there was no report or discussion other than what was discussed in open forum.

New Business: Storm damage was discussed. There are still some trees on Leewood property that are cause for concern. A letter will be sent to the Fairfax County Arborist so that a decision can be made on the removal of those trees, without violating any legality that may apply.

Old Business: No old business was discussed other than parking.
